Terms of Service

These terms are an agreement between you and Lurk (“we,” “us”) governing your use of our website, mobile apps, and related services (collectively, the “Service”). By accessing or using the Service you accept these terms.
1. Eligibility
You must be at least 18 years old to use Lurk. By using the Service you represent that you meet this requirement and that you have the legal capacity to enter into a binding contract.
2. Not affiliated with Instagram
Lurk is an independent third-party tool. We are notaffiliated with, endorsed by, or sponsored by Meta Platforms, Inc. or Instagram. “Instagram” is a trademark of Meta. We access only publicly available Instagram data and never log into your account on your behalf.
3. The Service
Lurk monitors publicly visible Instagram profiles you choose to track and surfaces changes in their follow graph. Data may be incomplete, delayed, or inaccurate if Instagram changes its surface area or rate-limits requests. The Service is provided on a best-effort basis.
4. Subscriptions & billing
Lurk offers subscription plans (e.g. weekly with an introductory price, and annual with a short free trial). Current pricing is shown in-app before checkout. Payments are processed by Stripe (web) or Apple/Google (mobile). Subscriptions auto-renew at the then-current rate at the end of each billing period unless you cancel before renewal. You authorise us to charge the payment method on file for each renewal.
5. Free trial
Some plans offer a free trial. To avoid being charged, you must cancel before the trial ends. We send a reminder email before trial conversion if you have linked an email address.
6. Cancellation & pause
You can cancel or pause your subscription at any time from Settings or from the Stripe customer portal. Cancellation takes effect at the end of the current billing period — you retain access until that date. Pausing suspends billing for 30 days; the subscription stays active and resumes automatically.
7. Refunds
Subscription fees are generally non-refundable once a billing period has begun. We may offer a refund at our discretion — for example, if you cancel within 24 hours of an unintentional renewal and have not made meaningful use of the period. EU/UK consumers retain any non-waivable statutory withdrawal rights. Email support@getlurk.app to request a refund.
8. Acceptable use
You agree NOT to use Lurk to:
- Harass, stalk, threaten, defame, or harm any person
- Identify or surveil minors
- Violate any applicable law or third-party right
- Scrape, decompile, or reverse-engineer the Service
- Resell or sublicense access to the Service without our written consent
- Bypass rate limits, authentication, or anti-abuse measures
We may suspend or terminate your access immediately if we believe you are violating these rules. Termination does not entitle you to a refund of unused subscription time.
9. Intellectual property
The Service, including its design, branding, source code, and content we create, is owned by us and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. Public Instagram content surfaced through Lurk remains the property of its respective owners and Meta.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We make no warranty about the accuracy, timeliness, or completeness of any data we surface.
11. Limitation of liability
To the maximum extent permitted by law, our aggregate liability for any claim arising from or related to the Service is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) US$50. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, even if advised of the possibility.
12. Indemnification
You agree to indemnify and hold us harmless from any claim, loss, or expense (including reasonable legal fees) arising from your misuse of the Service or breach of these terms.
13. Governing law & disputes
These terms are governed by the laws of the Province of Newfoundland and Labrador, Canada, without regard to conflict-of-laws principles. You and we agree that any dispute will first be raised by email to legal@getlurk.app and that we will attempt good-faith resolution before formal proceedings. Where statute permits, you waive any right to participate in a class action.
14. Changes
We may update these terms. Material changes will be announced in-app or by email if one is linked. Continued use after the “Last updated” date constitutes acceptance.
