1. Agreement to Terms
By downloading, installing, or using the Lurk mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
2. Description of Service
Lurk is a mobile application that allows users to view publicly available Instagram following information. The App shows recent follows from public Instagram profiles and can send notifications when tracked accounts follow someone new.
We only access information that is publicly available on Instagram. We do not access private accounts or require users to log into Instagram.
3. Eligibility
You must be at least 13 years old to use Lurk. By using the App, you represent that you meet this age requirement. If you are under 18, you should review these Terms with a parent or guardian.
4. Acceptable Use
You agree to use Lurk only for lawful purposes and in accordance with these Terms. You agree NOT to:
- Use the App to harass, stalk, threaten, or intimidate any person
- Use information obtained through the App to harm others
- Attempt to access private Instagram accounts
- Use the App in any way that violates applicable laws or regulations
- Reverse engineer, decompile, or disassemble the App
- Use automated systems or bots to access the App
- Resell, redistribute, or commercially exploit the App
- Interfere with or disrupt the App's functionality
5. Subscriptions and Payments
5.1 Subscription Options
Lurk offers premium features through subscription plans:
- Weekly subscription: Billed every 7 days
- Yearly subscription: Billed annually
- Lifetime purchase: One-time payment for permanent access
5.2 Billing
Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.

6. Intellectual Property
The App, including its design, features, and content, is owned by Lurk and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App.
7. Third-Party Services
The App interacts with Instagram to retrieve publicly available information. We are not affiliated with, endorsed by, or sponsored by Instagram or Meta Platforms, Inc. Your use of Instagram is governed by Instagram's own Terms of Service and Privacy Policy.
8. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:
- The App will be uninterrupted, secure, or error-free
- The information provided will be accurate or complete
- The App will meet your specific requirements
- Any defects will be corrected
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LURK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, data, or goodwill
- Personal injury or emotional distress
- Any damages resulting from your use of information obtained through the App
In no event shall our total liability exceed the amount you paid for the App in the past 12 months.
10. Indemnification
You agree to indemnify and hold harmless Lurk, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.
11. Privacy
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.
12. Modifications to Service
We reserve the right to modify, suspend, or discontinue the App at any time without notice. We may also update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the new Terms.
13. Termination
We may terminate or suspend your access to the App immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the App will cease immediately.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the App operator is located, without regard to conflict of law provisions.
15. Dispute Resolution
Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration, except where prohibited by law. You agree to waive any right to a jury trial or to participate in a class action.
16. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
